1. Acceptance of Terms

By accessing or using the Study Bully application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the App. These Terms apply to all editions of the App, including the School Age Edition, College Years Edition, and Careers Edition, and to all features therein, including but not limited to AI-powered quiz generation, image capture, AI counselor, reminder personas, quiz scheduling, Sparring Partners & Battles, banner advertising, push notifications, and subscription services.

2. Eligibility & Parental Consent

You must be at least 13 years of age to use this App. If you are under 18, you must have the consent of a parent or legal guardian. Users of the School Age Edition who are under 13 must have their account created and managed by a parent or guardian, who must complete email-based parental verification. Verification codes are valid for 10 minutes and must be entered by the parent or guardian before access is granted. A valid date of birth is required during registration for all editions. For the School Age Edition, your date of birth is used to calculate your age and determine eligibility; if your age surpasses the maximum allowable age for the School Age Edition, your access and subscription to that edition will be automatically disabled. By using the App, you represent and warrant that you meet these eligibility requirements, that the date of birth you provide is accurate, and, if applicable, that parental consent has been obtained.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration — including your name, email, date of birth, edition, and profile details such as grade level, college, or employer — and to update such information as necessary. Your date of birth is recorded at registration and cannot be changed afterward. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

4. Subscriptions, Plans & Payments

The App offers subscription plans (Starter and Pro) that provide access to different features and usage limits. Starter includes core study tools such as monthly study sources, image captures, quiz generation, active schedules, limited snoozes, and the default Chill reminder persona. Pro includes higher or expanded limits, plus premium features such as AI Counselor access subject to daily and monthly message limits, custom theme generation, advanced analytics and streaks, Focus Lock Mode, Sparring Partners & Battles, and per-quiz reminder persona selection, including Coach, Savage, and Sneaky. Pro subscribers may also send progress report emails as described below. Usage limits, pricing, and plan features are subject to change. Subscriptions automatically renew unless cancelled before the renewal date. Free trials, if offered, convert to paid subscriptions at the end of the trial period unless cancelled. We may also grant promotional, complimentary, or administrator-approved free access that provides Pro-level or other designated entitlements without charging the receiving user while that access remains active. For School Age Edition users, subscriptions and access will be automatically disabled if the user’s age (calculated from their registered date of birth) exceeds the maximum allowable age for that edition. All payments are processed through the applicable app store (Apple App Store or Google Play Store) or via RevenueCat. Refunds are subject to the policies of the respective app store.

4A. Free Access, Promotions & Administrative Overrides

Complimentary or administrator-granted access is personal to the receiving account, is not transferable, has no cash value, and may be limited to specific editions, features, or durations. If we determine that complimentary access was granted in error, obtained through abuse, or is being used in violation of these Terms, we may change or revoke that access at any time. Unless expressly stated otherwise, free access does not eliminate charges already incurred through Apple, Google, or other billing providers before the free access became active.

5. AI-Powered Features

The App uses artificial intelligence (“AI”) to provide features including image-to-quiz generation, text-to-quiz generation, and an AI counselor chat. AI features are powered by third-party services including OpenAI and Rork AI Toolkit. By using these features, you acknowledge and agree that: (a) images you upload are processed, compressed, and analyzed by AI to extract educational content and generate quizzes; (b) compressed image data may be temporarily hashed and cached to improve performance and reduce redundant processing; (c) AI-generated quizzes, study advice, and counselor responses are provided for educational purposes only and may contain inaccuracies; (d) Study Bully does not guarantee the accuracy, completeness, or reliability of any AI-generated content; (e) AI output token limits may vary by subscription plan; and (f) you should not rely solely on AI-generated content for academic, professional, or personal decisions. The AI counselor is not a substitute for professional educational, psychological, or medical advice.

6. Image Capture, Processing & Caching

When you use the image capture feature, your images are compressed (resized to a maximum of 1280px on the longest side, converted to JPEG at approximately 75% quality) before being sent to AI for analysis. A cryptographic hash (SHA-256) of the compressed image combined with your subscription plan is generated and stored in our database to enable caching. Cached results for accepted images are retained for up to 30 days; cached results for rejected images are retained for up to 2 hours. Caching is used solely to improve performance and reduce processing costs. You retain ownership of all images you upload, but you grant us a license to process, compress, hash, cache, and transmit them as necessary to provide the service. Images that are rejected by the AI (e.g., blurry, non-educational, unreadable) will not produce quiz content and may be briefly cached to prevent repeated processing.

7. Advertising & Banner Ads

Users may purchase advertising (banner ad) space within the App to celebrate achievements. All advertisements must comply with our content guidelines and are subject to review and approval. We reserve the right to reject, remove, or modify any advertisement at our sole discretion. Purchased ads are displayed to all registered users within the same edition on the scheduled date. Ad pricing, availability, scheduling, and display duration are subject to change. Users may react to ads; reaction data is collected and displayed to ad purchasers. For School Age Edition users, all ad purchases require verified adult/guardian approval. Ad transactions are recorded and visible in the user’s transaction history. Study Bully is not responsible for the content of user-submitted advertisements beyond initial review.

8. User Content & Conduct

You retain ownership of content you create within the App, including study materials, uploaded images, quiz responses, counselor conversations, achievement ads, and profile information. You grant us a non-exclusive, worldwide, royalty-free license to use, display, process, compress, cache, and transmit your content as necessary to operate, maintain, and improve the App. You agree not to: (a) upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable; (b) upload images that contain personally identifiable information of third parties without consent; (c) attempt to circumvent usage limits, subscription restrictions, or caching mechanisms; (d) use the AI features to generate harmful, misleading, or inappropriate content; (e) misuse the parental verification system; or (f) engage in any activity that interferes with the App’s operation or other users’ experience.

9. Usage Tracking & Limits

The App tracks your usage of certain features, including study sources, image captures, quizzes, schedules, snoozes, AI counselor messages, reminder persona settings, and battle participation, on daily and monthly bases where applicable. Usage data is associated with your user account and stored securely in our database. Usage limits are enforced based on your subscription plan and are subject to change. If you exceed your usage limits, access to the corresponding feature may be restricted until the next applicable period. Usage tracking is necessary to ensure fair use of App resources, enforce plan entitlements, and maintain service quality for all users.

10. Push Notifications & Scheduling

The App may send push notifications to remind you of scheduled quizzes, study sessions, battles, and other App-related events. You may opt in or out of notifications through your device settings. The App schedules local notifications based on your quiz schedules, reminder preferences, and selected reminder persona. Starter users receive the default Chill reminder tone, while eligible Pro users may customize reminder wording by quiz using available personas. We do not send unsolicited marketing notifications without your consent.

10A. Progress Report Emails

Pro subscribers may send progress report emails summarizing their study activity and quiz performance. For the School Age Edition, progress reports are sent to the verified parent or guardian email address on file. For the College Years and Careers editions, users may input any email address of their choosing to send progress reports to. By using this feature, you represent that you have the right to send emails to the provided address and that the recipient has consented to receive such communications. Study Bully is not responsible for the delivery, receipt, or use of progress report emails once sent. This feature is available exclusively to Pro plan subscribers.

10B. Reminder Personas, Sparring Partners & Battles

Certain Pro features let you select reminder personas for individual quizzes, create or share Sparring Partner codes, send or accept partner requests, initiate or join quiz battles, submit quiz scores or results, and review battle activity or history. By using these features, you consent to the display of limited account and activity information, such as your display name, partner status, quiz title, battle participation, submitted answers, answer correctness, scores, wins, losses, ties, streaks, timestamps, and battle outcomes, to the other users involved in the relevant interaction. School Age Edition users may be subject to edition or grade-level participation restrictions. We may limit, suspend, or remove access to these features in cases of abuse, harassment, cheating, or other violations of these Terms.

11. Intellectual Property

The App and its original content, features, functionality, AI prompts, quiz-generation algorithms, and user interface design are owned by Study Bully and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, reverse-engineer, or lease any part of the App without our prior written consent. AI-generated quiz content is provided to you for personal educational use only and may not be redistributed commercially.

12. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. We make no warranties, expressed or implied, regarding the App’s reliability, availability, accuracy, or fitness for a particular purpose. Specifically, we disclaim all warranties regarding: (a) the accuracy or educational value of AI-generated quizzes, study material extraction, or counselor advice; (b) the availability or uptime of AI processing services; (c) the completeness of text extracted from uploaded images; (d) the suitability of the App as a sole educational resource; and (e) the security of cached or stored data beyond industry-standard measures.

13. Limitation of Liability

In no event shall Study Bully, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to: (a) your use of or inability to use the App; (b) any errors, inaccuracies, or omissions in AI-generated content; (c) any unauthorized access to or alteration of your data; (d) any loss of academic opportunity, grades, or professional advancement resulting from reliance on the App; (e) any advertisements displayed within the App; (f) any interruption or cessation of AI processing services; or (g) any other matter relating to the App. Our total liability shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Study Bully and its officers, directors, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) content you upload, including images and advertisement materials; (d) your misuse of AI-generated content; or (e) your violation of any third-party rights.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms, abuse of AI features, circumvention of usage limits, or submission of inappropriate content. Access to the School Age Edition will be automatically terminated if the user’s age (as calculated from their registered date of birth) exceeds the maximum allowable age for that edition. Upon termination, your right to use the App will cease immediately. Cached data associated with your account may be retained or deleted at our discretion. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute resolution — shall survive.

16. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the App immediately.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
